    • Rainey Collins’ Legal Executive elected to National Body
      • We are delighted to announce that Lindsey Mills has been elected to the National Council of the NZ Institute of Legal Executives. Lindsey is a key member of the Business and Personal Legal Services Team, specialising in Conveyancing, Wills, Enduring Powers of Attorney and Estates. She is a fully qualified Registered Legal Executive with many years experience and had the honour of being an Upper Hutt Excellence in Business award winner when she was judged Employee of the Year at the inaugural event in 2007. Lindsey prides herself on being approachable and building a strong relationship with clients. She is an excellent communicator and top professional who takes care in assisting clients through what can be highly stressful times in their lives. She is extremely passionate about her role and receives positive feedback on a regular basis from the firms clients. The NZ Institute of Legal Executives is the professional association for legal executives in New Zealand. It was established in 1975 and has in excess of 1100 members. Lindsey’s appointment is a prestigious one and reflects her senior standing in the profession.

    • Rainey Collins celebrates milestones
      • The firm recently held a joint celebration for two significant milestones. James Johnston joined the firm 26 years ago and Alan Knowsley 30 Years ago.  James and Alan both started out as newly qualified solicitors under the guidance of the then partners of the firm and have progressed to become Chairman and Managing Partner and heading the Business/Personal and Litigation teams of the firm respectively.  The firm’s commitment to client service continues with James and Alan passing on their many years of experience to the newer members of the firm.

    • Rainey Collins Chairman helps to launch new book on Family Group Conferences…
      • Rainey Collins Chairman James Johnston was pleased to MC at the recent launch at Te Papa of the book, “New Zealand’s Gift to the World”, celebrating 25 years of the Youth Justice Family Group Conference. James drew upon his experience as a former Youth Advocate, and congratulated the key figures involved in bringing the project to its fruition. Supported by the Henwood Trust, the project drew upon many sectors according to Mr Johnston who said, “The book represents a conversation and collaboration with many voices, rather than a purely academic text. It also will be a useful handbook for those dealing with youth at the coal-face, as well as lifting the hood on how the FGC works…in a less formal style that is easier to read and more accessible for all New Zealanders”. Other speakers included Co-author Judge Carolyn Henwood, Principal Youth Court Judge Andrew Becroft, and Deputy Prime Minister Bill English who launched the book.     • Wellington Young Professionals
      • Rainey Collins has renewed its sponsorship of the Wellington Young Professionals organisation for a further two years.  The firm is proud to support up and coming professionals who are contributing so much to Wellington through their careers.

    • Employer closes business but doesn’t tell employee…
      • An employee’s personal grievance claim for constructive dismissal has been upheld by the Employment Relations Authority. The employee worked in a retail shop and was told the shop would be closed for repairs for three days so not to come to work those days. When passing the shop she saw that the shop looked to be in the process of being abandoned but her employer told her no decisions on closure had been made. The ERA said that the employer should have kept her informed of the position with closure and entered into consultation with her about possible redundancy, or hours at another store. The ERA held the employee was entitled to resign due to the complete breach of trust by the employer over the closure of the shop. Lost wages of $2,472 plus compensation of $3,000 were awarded.

    • World Justice Project 2014 rankings for New Zealand released
      • Partner Alan Knowsley was again one of the 2500 experts around the world consulted by the World Justice Project to rank 99 countries on the issues of Constraints on Government Powers, Absence of Corruption, Open Government, Fundamental Rights, Order and Security, Regulatory Environment, Civil Justice and Criminal Justice. New Zealand ranked in the top 12 countries in all categories ranging from 2nd for Open Government and 3rd for Absence of Corruption to 12th for Criminal Justice.     • Rainey Collins Partner Interviewed for TV3 News
      • Partner Alan Knowsley was interviewed by TV3 News reporter Emma Jolliff in relation to the legal issues involved in the revelations of email hacking, database searching etc arising from the Nicky Hager book launch.  Alan explained the differences in searching a publicly open website compared to breaking into a secure website or someone’s home.  He also explained why serious allegations made in the book may not result in legal proceedings for defamation due to the need to avoid further publicity.

      • Rainey Collins Chairman James Johnston was pleased to welcome Real Estate Agents from most of the various agencies in the region to our annual agent function hosted recently at our offices. The event was an opportunity for Real Estate professionals to get together and catch up with colleagues and friends in the industry, to discuss the topical issues of the day as they affect the profession, and also to enjoy some of our hospitality. James briefly addressed the gathering on the changing face of client service and this was well received by attendees.

    • Education Law Association Seminar at Rainey Collins
      • The first in this year’s series of Australia New Zealand Education Law Association seminars around the country was held at our offices on 24 July. The seminar was attended by members from several different parts of the education law sector. The session was chaired by Virginia Goldblatt of the Massey University Dispute Resolution Service. The presenters were Emmett Geoghegan Senior Solicitor Ministry of Education and Alan Knowsley (ANZELA Board Member and Immediate Past President). There were in attendance a principal, a Deputy Principal, an Associate Principal,  lawyers in private practice,  members of the Teachers Council Disciplinary team and the Police. Much of the discussion centred around the lessons to be learned from the recent Hair Cut case. The school rule that was too uncertain to be lawful, the failure to actually apply the rule, the failure to get the suspension process right by the Principal and Board, the disciplining of others involved in the dispute etc Also discussed were the opportunities to resolve these disputes by alternative processes like mediation or negotiation. Hand outs were provided on student and staff discipline, dispute resolution processes, Ombudsman’s Guide to handling unreasonable complainants, guidelines for the surrender and retention of property and searches, bullying prevention and response and good decision making processes. Further seminars in the series will be held in Tauranga and Auckland with one also being planned for Christchurch. Please contact Alan Knowsley if you would like more information.

    • School Trustees Association AGM and Conference
      • Partner Alan Knowsley attended the Association’s annual conference and AGM in Auckland recently. There were around 900 trustees and principals there from schools through out the country. The conference was addressed by both the Minister of Education, The Honourable Hekia Parata, and the Secretary of Education, Peter Hughes, as well as other key note speakers from New Zealand and the USA. Multiple workshops on all aspects of Board of Trustees responsibilities were held over the 3 days ranging from how to prevent and deal with bullying, to how to conduct the principal’s performance review. Great seminars with lots of participation from the attendees. A very inspiring conference and lots of learning to take away.

    • Education Law Seminar – Prevention, Punishment & Process
      • This ANZELA (Australia New Zealand Education Law Association) event will be held at Rainey Collins, 171 Featherston Street, Wellington from 4pm – 6pm on Thursday 24 July 2014. Topics to be covered will include search and seizure, employment investigations, student disciplinary investigations, suspension and expulsion procedures and alternative processes for dealing with difficulties. The speakers will be Virginia Goldblatt, Director of the Massey University Mediation Service, Emmett Geoghegan, Senior Solicitor at Ministry of Education and Alan Knowsley, Partner at Rainey Collins Lawyers.     • Wellington Young Professionals
      • Rainey Collins recently hosted the Wellington Young Professionals Sponsors’ night at our offices. WYP is an educational and networking group and is well supported by local businesses. The evening was attended by WYP Committee members along with representatives from sponsors and partners – Xero, Hotel Intercontinental, Regus, and Rainey Collins. Since the Sponsors’ evening, WYP held a successful ‘speed networking’ event at Plum Café which saw many ‘matches’ of both member and non-member attendees.  WYP holds regular events, details of which can be found on its website – www.wyp.co.nz.  The next event is the monthly WYP drinks (held the first Wednesday of each month), at 5:30pm on Wednesday 2 July at Foxglove.

    • Important change to tax payment dates…
      • At present the IRD accepts that any payments postmarked on the day payments are due will be within time and not attract late penalties or interest.  From 1 October 2014 this will change and all payments must reach the IRD by the date for payment or penalties and interest will apply.

    • Senior Associate presents on family law
      • Rainey Collins Senior Associate Debbie Dunbar recently presented to Interpreting New Zealand on family law issues.   The presentation provided an overview of some of the family law topics Rainey Collins deals with including separation, relationship property division, financial support, child care, guardianship and domestic violence. During the presentation Debbie relayed the importance for people to obtain legal advice as early as possible in a separation situation.  The need for people to obtain expert advice was also pressed upon attendees.  Specialist family lawyers should be able to provide advice that is up to date and relevant to the particular client’s situation. The presentation was well received with plenty of questions and interest.  Feedback received from Interpreting New Zealand training officer Inna Palmer thanked Debbie for the “wonderful presentation” and stated that the attendees “found your material very informative on all levels and so very enjoyable”.

    • Jono Griffith Secretary of the Wellington Young Professionals meets the Prime Minister
      • At a recent meeting of the Wellington Young Professionals (WYP), Rainey Collins Senior Solicitor Jono Griffith was appointed as secretary. WYP is a group set up to provide networking opportunities for people in the first few years of their professional careers.  WYP holds regular events throughout the year.  Recently the Prime Minister, the Honourable John Key, met with over 100 of the group for after work drinks on the waterfront.  He talked about his views on job creation, business opportunities, migration (in and out) and the flag.  The Prime Minister then took questions and mingled with the members.
